The first step is to determine who will represent the estate.
If there’s a Will, the representative is the Executor named in the Will.
If there isn’t a Will, the representative can be the spouse, child, or other relative of the person who passed away.
You, as the representative, will meet with one of our attorneys to discuss the probate process and help you determine who are the rightful beneficiaries of the estate.
If there’s a Will, the beneficiaries are often – but not always – the people named in the Will.
If there isn’t a Will, the beneficiaries can be the spouse, children, or other relatives of the person who passed away.
